Terms of Use

In the event of any discrepancy between this translation and the Japanese version,
the Japanese version shall prevail.

Article 1 (Scope of Application)

These Terms of Use (“Terms”) apply to users (“Users”) when using the iOS application “Ima Koko Map” (“App”) provided by Magic Works (“Provider”).

Article 2 (Definitions)

The terms used in these Terms shall have the following meanings:

Article 3 (Amendments to the Terms)

  1. The Provider may modify these Terms as necessary.
  2. The revised Terms shall take effect from the time they are displayed within the App or on the official website.
    Users who do not agree to the revised Terms must immediately cease using the App.

Article 4 (User Environment)

Users shall, at their own responsibility and expense, prepare the necessary communication environment (such as internet connection or mobile data) and devices (such as smartphones or tablets) required to use the App.

Article 5 (Handling of Personal Information)

The Provider shall properly manage Users’ personal information and handle it in accordance with a separately established Privacy Policy.

Article 6 (Prohibited Acts)

Users shall not engage in the following acts when using the App:

  1. Acts that violate laws, regulations, or public order and morals
  2. Acts that infringe upon the intellectual property rights or privacy rights of other Users, third parties, or the Provider
  3. Acts that interfere with the operation or provision of the App or the use of the App by other Users
  4. Acts that exploit vulnerabilities in the App, or use unauthorized programs or scripts
  5. Acts that disclose, provide, or share other Users’ location information to third parties without consent
  6. Harassment, defamation, threats, or sending of illegal content in group chats
  7. Use of the App for purposes other than its intended use (including commercial, religious, or political activities)
  8. Dissemination of information related to, or provision of benefits to, antisocial forces
  9. Any other acts deemed inappropriate by the Provider

Article 7 (Intellectual Property Rights)

All intellectual property rights related to the App and related materials (including programs, designs, and images) belong to the Provider or rightful owners.
Users retain the copyright to content they post, but the Provider shall have a non-exclusive right to use such content for the operation and improvement of the App.

Article 8 (Disclaimer)

  1. The Provider makes no guarantees regarding the accuracy, completeness, usefulness, timeliness, or safety of the App, its functions, or content.
  2. The Provider shall not be liable for any disputes or troubles between Users arising from group chats or location sharing.
  3. The Provider shall not be liable for any damages resulting from errors, delays, or inability to obtain location information.
  4. The Provider shall not be liable for any damages caused by device malfunctions, connection issues, or OS updates.
  5. The Provider shall not be liable for service interruptions or termination caused by natural disasters, system failures, or other reasons beyond its control.
  6. The Provider shall not be liable for damages arising from the use or inability to use the App (including loss of data or opportunity).
  7. The information provided in the App may not necessarily suit a User’s specific purpose. Users shall use the App at their own discretion and responsibility.

Article 9 (User Responsibility)

  1. Users are responsible for carefully selecting the individuals with whom they share their location information and for properly configuring sharing settings.
    The Provider shall not be liable for information leaks caused by sharing errors or misconfigurations.
  2. Users are solely responsible for any content they post or transmit within a Group.
    If such content infringes upon the rights of third parties or violates laws, the User shall resolve the issue at their own expense and responsibility.
  3. If a dispute arises between a User and a third party in connection with the use of the App, the User shall resolve the dispute at their own expense and responsibility.

Article 10 (Measures in Case of Violation)

  1. If a User violates these Terms or is deemed inappropriate by the Provider, the Provider may suspend the User’s use of the App without prior notice.
  2. The Provider shall not be liable for any damages arising from such suspension.
  3. If the User’s violation causes damage to the Provider, the Provider may seek compensation from the User.

Article 11 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan.
Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Sendai District Court as the court of first instance.

Supplementary Provision

These Terms shall come into effect on May 15, 2025.
